Few things are as egregious as sexual misconduct.

We believe real sexual assault should be punished to the full extent of the law.

 

We also believe it is equally despicable for politicians to not only use, but incentivize, bogus sexual-assault allegations and unconstitutional trials as tools for their own political gain, yet that is exactly what's happening. 

How Our Warriors Became Political Pawns

No one wants to see sexual assault go unpunished, especially in an institution as critical to national security as the military. So, to make a strong statement that sexual assault will not be tolerated, the Obama administration, and key Senators, overreacted and undid the rules of due process in the military.

Threaten the Commanders

Commanders tasked with "cleaning up" the military see their careers rewarded or punished based on how many sexual assault cases they "successfully" oversee.

Grant Accusers "Special Victim" Status

 "Special victims" claims are not allowed to be investigated, for fear of increased "shaming" and such "victims" now receive preferential treatment for their career path.

IS THERE A SEXUAL ASSAULT "CRISIS" IN THE MILITARY?

 

In 2013, a narrative surfaced about a "sexual-assault crisis” happening in the military.

 

That year the Department of Defense did a survey of 2% of the military. (1)

It was extrapolated from that survey (by senators such as Claire McCaskill (D-MO), Jackie Speier (D-CA) and other policy makers), that this survey confirmed there had been some 26,000 sexual assaults in the military the prior year. (2)

HERE'S WHAT THEY'RE NOT TELLING YOU

The big problem with this survey is that it did not ask people if they were actually sexually assaulted.

 

Instead, it asked them if they had experienced any instances of “unwanted sexual contact.” (3)

That, of course, could mean anything.

 

If you have consensual sex and then later regretted it, couldn’t this be unwanted sexual contact?

 

It seems so.

HOW YOU KNOW YOU'RE FIGHTING AN AGENDA

 

Claire McCaskill (D-MO) even admitted that unwanted sexual contact" could mean anything from someone “looking at you sideways” to full blown rape. (4)

As you can imagine, extrapolating real instances of assault from such a flawed survey is impossible.

 

Despite this, Jackie Speier (D-CA) thought it would be a good idea to go on CBS’ Face the Nation and tout 26,000 as the number of sexual assaults in the military, even though there was no evidence to support her claim.

The prior year, when a similar survey came out, estimating that there could have been 19,000 instances of “unwanted sexual contact” in the military, Congresswoman Speier stormed Capital Hill with the message that “there are 19,000 rapes that occur in the military every year.”  (5)

Not only is that extrapolation beyond reasonable, it begs the question of why these senators would spread such an obviously contrived narrative.

Here's what they did next.

WHERE GOOD INTENTIONS MEET POLITICS

Obviously, no one wants to see sexual assault go unfettered in the military.
 

Because sexual assault is an awful crime, no reasonable person would object to trying to stop it.

Yet, instead of trying to get to the real numbers and deal fairly with genuine instances of sexual assault, Kirstin Gillibrand (D-NY), Clair McCaskill (D-MO) and Jackie Speier (D-CA) and others seemed to almost salivate at the opportunity to leverage this made-up narrative to advance their careers. 

And so they did.

THE DISMANTLING OF DUE PROCESS

In recent years they have zealously and repeatedly called for the removal of any military commander who declined to prosecute sexual assault cases with insufficient evidence. (6)
 

They have even gone so far as to block promotions, and force the retirement of, commanders who don't go along with the “always-believe-the-victim” narrative. (7)

When falsely accused soldiers are found to be innocent, and return home to their families, these senators call it a “travesty of justice” (8) and tell the public that this is evidence the military is allowing sexual predators “to continue to prey on unsuspecting victims.” (9)

Through unlawfully influencing military command at every level, and incessantly attacking the due process rights of American Soldiers, Gillibrand, McCaskill, Speier and others have turned countless, upstanding, military personnel into a legion of scapegoats by painting them as violent predators in uniform, lurking behind tanks, waiting to pounce on any woman unfortunate enough to join the ranks.

They then gift wrapped this “crisis” narrative and presented it to their friends in the mainstream media.

UNFAIRLY CHANGING THE RULES

Under the Obama administration, more than 100 statutory reforms and policy changes were implemented regarding sexual assault in the military. (10)

Instead of any good that may have been intended from those reforms, what came instead was 1) a wave of political correctness that incentivize women to claim to be a victim, and 2) a new set of rules that only served to bind the hands of defense attorneys.

 

Here are just three ways defense attorneys lost their ability to do their job:

  • The title of “special victim” of sexual assault is given to anyone if they make a mere accusation.

  • Such "special victims" also get their own attorneys called “special victims counsel” and “special victim prosecutors” are used to prosecute the accused and the accuser is referred to as a “special victim” repeatedly in front of the jury before a verdict is even reached.

  • The defense no longer gets to interview the “special victim” before trial.

  • If an accuser had falsely accused men of rape in the past, the defense cannot bring this up because it is embarrassing for the “special victim.”

 

HOW DO WE KNOW THIS IS HAPPENING?

The Judicial Proceedings Panel (JPP) is a subcommittee comprised of judges and retired military members established by the Secretary of Defense to research and report on topics of military justice. During the execution of American military installation site visits, where more than 280 people involved in the military justice process were extensively interviewed, they reached the following conclusion:

 

“Judge Advocates overwhelmingly reported a perception of pressure on convening authorities [the commanding general in charge of establishing a trial by court martial] to refer sexual assault cases to court martial, regardless of merit. According to many of the Judge Advocates interviewed on site visits, this pressure extends to weak cases that civilian jurisdictions would not prosecute and, in some cases, have already declined to prosecute.”  (11)

 

The progressive fragmentation of due process rights for those accused of sexual assault in the military has led to innocent men getting absolutely steamrolled and spending decades behind bars for crimes they did not commit.

 

Every day that passes is another day that these casualties of political warfare sit alone in a cell.

Since 2013 these progressive, left-wing democrats who want an issue to run on, have used sexual assault in the military as a way to advance their own careers.

It's not right. It's not American, and it needs to stop.
